Key take away this week

The withdrawal agreement has brought with it a multitude of declarations, statements and protocols. However, with dissatisfaction from all sides regarding the deal in question, it remains to be seen what extent of these new developments will come to pass. We will continue to stay on top of all updates as we hopefully continue to move closer towards knowing what a post-Brexit future may look like. 

 

Brexit Developments

The EU Commission has published detailed Q and A factsheets on the withdrawal agreement and the Northern Ireland protocol.  View> 


Under the proposed withdrawal agreement Union law (including amendments), customs union and trade rules will continue to apply during the transition period. Goods placed on the market during transition will be allowed free circulation post transition except for products of animal origin. The transition period will apply to 31st December 2020 but the UK may request one extension through a joint committee by 31st July 2020. The UK will have no role in EU decision making. The CJEU will be supreme during transition and for four years thereafter. NI backstop will apply from 31st December 2020 until a future partnership agreement is in place. The UK may request an extension to postponement of the backstop arrangement but there can be no hard border whatever the circumstances.

 

The outline political declaration on a future relationship in respect of goods reads as follows:

GOODS

● Comprehensive arrangements creating a free trade area combining deep regulatory and customs cooperation, underpinned by provisions ensuring a level playing field for open and fair competition as described below.

● Zero tariffs, no fees, charges or quantitative restrictions across all goods sectors, with ambitious customs arrangements that build on the single customs territory provided for in the withdrawal agreement, respecting the parties’ legal orders.

● Extent of the United Kingdom’s commitments on customs and regulatory cooperation, including with regard to alignment of rules, to be taken into account in the application of checks and controls at the border.

● In this context, recalling the Union's and the United Kingdom's intention to replace the backstop solution on Northern Ireland by a subsequent agreement that establishes alternative arrangements for ensuring the absence of a hard border on the island of Ireland on a permanent footing.
