Public Liability: defendant not liable for fall over banister in nightclub premises

Recent Cases

  • Successful dismissal of an accident case at limitation trial - the case was commenced 5 years late by an employee of a high profile equine establishment following a riding accident. There was no good reason for the delay.
  • Successfully defending a nightclub at trial after the Claimant alleged that he sustained injury due to bannisters being too low (article below and also featured on BBC's Claimed and Shamed)
  • Succeeding at trial on a Hand Arm Vibration Syndrome case on the basis that the Claimant had knowledge for limitation purposes at least 40 years earlier.
